(1) Age (your age, not the wine!)

You must be 18 years or over to purchase alcoholic beverages from this site.

It is an offence to purchase or attempt to purchase alcohol if you are under the age of 18.

If you are buying wine as a gift, the recipient must also be over 18 years of age. Our couriers may ask for proof of age of the recipient on delivery. If this proof cannot be given, unfortunately, the wine cannot be delivered.

Once you have taken receipt of delivery, the recipient is responsible for it.

(2) Delivery

After you have placed your order, we will send you an order confirmation email.

We expect to deliver within three working days of receipt of your order. For deliveries to more remote areas, delivery can take a couple of extra days.

Our delivery charge is per delivery address, regardless of whether the order is for one bottle or a thousand bottles. Standard delivery charges are £5.99 for local deliveries (DD1 to DD6), £14.99 for UK courier deliveries on orders up to £20 and £8.99 for for UK courier deliveries on orders between £20 and £150.

FREE DELIVERY: UK Courier delivery is free of charge if you spend £150 or more. For customers in postcodes DD1 to DD6 inclusive, delivery is free of charge if you spend £65 or more. Otherwise, standard delivery charges apply. 

We normally deliver Monday to Friday, 10.00am to 5.30pm, but during busy times, deliveries may be made outside of these times. We can deliver to places of work if you request it at the time of order.

If you are not in when the courier attempts to deliver, then a card will be left informing you that an attempted delivery had been made. If you do not contact the courier company, a second attempt will be made. Alternatively, you may authorise the courier to leave the order in a certain place. There is a textbox in the shopping checkout where delivery instructions can be left should no one be home to meet the courier. Let us know if you want the courier to leave your order in a certain spot (e.g. at back door or in a shed etc). IMPORTANT NOTE: if a request is made for wine to be left unattended we cannot be held responsible if the wine goes missing after the courier has delivered it. If there is no contact after the second missed delivery, the wine will be returned to us and we will credit your account, less the delivery charge.

In the unlikely event that there are any breakages, the carrier will need to collect the damaged case including the damaged contents. If you have any queries regarding delivery please contact us at team@aitkenwines.com

 

(3) Prices and payment

All prices are quoted in pounds sterling and may be per item or bottle or per case, as marked. The prices include UK duty and VAT at a rate of 20%, unless otherwise clearly stated. Any delivery charges are additional to the unit price quoted. Each bottle is 75cl unless otherwise stated.

We accept payment by Maestro/Solo, Switch, Visa, MasterCard and PayPal. In the case of payment by bank transfer or cheque, the order(s) will only be shipped when cleared funds have been received into our bank account.

We reserve the right to terminate any special offer at any time, without notice.

  

(4) Wine does run out, sometimes

If we run out of a particular vintage, we may choose to substitute this with another vintage or with wine of equal or greater value. If we have to substitute for a different wine, we will email you before we despatch the goods to let you know. We may choose to refund your money instead of sending out a substitute. Please note that this is a very unusual occurrence, and we will never use this clause as an excuse to replace good wine with plonk. Please be aware that the wine pictured may not be indicative of the vintage we currently stock. (5) Return, Refund and Cancellation Policy

Hey, we all make mistakes. If you order something by mistake, let us know before we ship it out and we will cancel the order and refund you any money. If you change your mind within 14 days of placing the order, return the unopened product and we will refund the value of the product, less any shipping costs.

All of the wine we sell is sold in glass bottles. Unfortunately, glass is fragile and breakages occasionally occur. Just for your information, we use a specialist wine courier company that has proven to be highly reliable, but we understand that sometimes breakages do happen. If they do occur, all that we ask is that you let us know within three days of the courier delivering the wine to you. We will then ask you to return (via the courier at our cost) the original package and any other spoilt bottles. We will then credit you for the wine returned or redeliver a replacement (hopefully without any breakages on the second time!).

(7) Liability and really small print

We shall not be liable for any delay in delivering your wine if that delay or failure is caused by circumstances beyond our control such as war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, fire, flood, storm or Act of God, failure of ISP or telecommunications or courier service provider in connection with the performance of this Agreement.

The images, words and descriptions on the website are for guidance only. Final products may look different to the image shown.

Aitken Wines may change or add to these terms and conditions for security, legal or regulatory reasons. We will not use this right to vary the terms of any special offer that applies to you.

The sale of the goods takes place only when the wine is despatched from our warehouse. Until that time, Aitken Wines will not be bound to supply the goods or agree the price.

Nothing in these Terms and Conditions will reduce your statutory rights relating to faulty or misdescribed goods. Further information about your rights is available from your Local Authority Trading Standards Department or Citizen's Advice Bureau.

You agree and acknowledge that Aitken Wines owns or are licensed to use all copyright, database rights, trademarks and other intellectual property rights in and to all parts of this website.

You are entitled to use our website in accordance with these Terms and Conditions only. You must obtain our prior written consent before you use our website or any part of it in any other manner.

All persons, individual and corporate, are prohibited from providing hypertext or other links to the Aitken Wines website from their own website or from a third party's website, without our prior written consent.

Nothing in these Terms and Conditions shall exclude Aitken Wines from liability for personal injury or death caused by its negligence. 
We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where: 
- loss or damage was not foreseeable to both parties when the contract was formed; 
- loss or damage was not caused by any breach on the part of the supplier; 
- loss or damage relates to business and/or non-consumers.

We will not be liable for loss or damage caused by the customer handling the wine. In particular, we will not be liable for spillages or breakages.

Customers should also be aware of the following inherent risks and warnings: 
- Alcohol should be consumed in moderation 
- A case of wine is heavy so extra care should be taken when lifting it. If you are concerned about the weight we advise that you transfer the bottles 1 or 2 at a time.
- Port and red wine, in particular, may cause staining if spilt so extra care should be taken. 
- Sparkling wines and champagnes can be volatile due to the build-up of gasses, extra care should be taken when opening these.
- Wines may contain Sulphites unless stated otherwise.

By providing your details to Aitken Wines on our website, you consent to Aitken Wines maintaining, recording, holding and using the information you give Aitken Wines at the time of ordering to process your orders, to improve our service to you and inform you of promotions. All data is collected lawfully and maintained in accordance with the Data Protection Act 1998.

We take your privacy very seriously and will not pass your details to any third party without your permission, other than where we have to do so to get your wine to you, e.g. our delivery courier. From time to time, Aitken Wines may send information about discounts and offers on wine, port or champagne, unless you have told us not to do so by emailing us team@aitkenwines.com.

Relevant United Kingdom law will apply to these terms and conditions and the relevant courts of the United Kingdom will have exclusive jurisdiction.
